1. Who provides this website
This website, at www.awakeagency.dev, is provided by Mykyta Kashcheiev, trading as Awake Agency, Warsaw, Poland, NIP 1133116067, REGON 526996481, registered in the Polish CEIDG register. You can reach us at contact@awakeagency.dev.
2. What this site is
It is a portfolio and a way to start a conversation. There are no user accounts, no payments, no downloads and no shop. The services provided electronically here are limited to:
- reading the pages;
- sending us your name, e-mail and a short note through the contact flow, which carries them into a booking;
- booking a call through the third-party calendar on the contacts page.
All of it is free of charge. Nothing on this site is an offer within the meaning of Article 66 of the Polish Civil Code. A project only begins when we both sign a separate written agreement, and that agreement, not this page, governs the work.
3. What you need to use it
A current version of any major browser, JavaScript enabled, and a working internet connection. Some parts of the site, the booking calendar in particular, will not run without JavaScript. We do not guarantee uninterrupted availability: the site may be down for maintenance, or because something upstream is.
4. Using it properly
You agree not to:
- send us unlawful content, or content that infringes anyone rights;
- attempt to disrupt the site, gain access you were not given, or probe it for weaknesses;
- scrape or harvest it automatically at a rate that burdens it, or reuse its contents commercially without our permission.
If you believe you have found a security problem, please write to us before telling anyone else. We would rather hear it from you.
5. What belongs to whom
The design, code, text and structure of this site are ours. The client work shown in the case studies belongs to the clients who commissioned it; their names, logos and screenshots appear here as a record of work we did, with their permission, and remain theirs. Nothing here transfers any right to you. You may quote or link to a page, with attribution; you may not republish it.
6. Your data
What we collect, why, and what you can ask us to do about it is set out in the Privacy Policy. What the site stores on your device is in the Cookie Policy.
7. Complaints
If something about this website or a service provided through it goes wrong, write to contact@awakeagency.dev with what happened and what you would like us to do. We reply within 14 days. If you are a consumer and we cannot agree, you may use the EU online dispute resolution platform at ec.europa.eu/consumers/odr, or the routes offered by the Polish consumer ombudsman. We are not obliged to use out-of-court dispute resolution and will say case by case whether we agree to.
8. Liability
We take care that what is published here is accurate, but the site is informational: figures, timelines and descriptions of past work are examples, not promises about your project. To the extent Polish law allows, we are not liable for decisions taken on the basis of this site alone. Nothing here limits liability that cannot lawfully be limited, in particular for intentional harm, or for consumer rights under Polish law.
9. Governing law
Polish law applies. If you are a consumer, this does not deprive you of the protection of mandatory rules in your own country of residence.
10. Changes
We may change these terms, for example when the site gains or loses a feature. The date at the top shows the current version, and the version in force when you use the site is the one that applies to that use.
